Professional License Defense

License Defense for Contractors and Skilled Trades

A contractor licence is what makes the business lawful, and a complaint can threaten the licence, the qualifying individual behind it, and a recovery-fund claim at the same time. We represent contractors and licensed trades in these proceedings.

Licensing Authorities

Who Regulates This Field

The regulator differs by state, and so do the procedures that follow from it.

Virginia

The Department of Professional and Occupational Regulation, through the Board for Contractors, which issues Class A, Class B, and Class C contractor licences, specialty designations, and tradesman licences for the electrical, plumbing, and HVAC trades.

Florida

The Department of Business and Professional Regulation, through the Construction Industry Licensing Board and the Electrical Contractors' Licensing Board. Florida distinguishes certified statewide licensure from registered local licensure.

New Jersey

Home improvement contractors register with the Division of Consumer Affairs rather than holding a licence. Licensed trades are regulated by their own examining boards within the Division — the Board of Examiners of Electrical Contractors, the State Board of Examiners of Master Plumbers, and the State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration Contractors.

What We See

Matters That Recur in This Field

The categories below describe the kinds of allegation that commonly arise. They are not a statement about any particular matter.

  • Workmanship and construction defect complaints
  • Abandonment and failure to complete allegations
  • Permitting and code compliance allegations
  • Contract content and required-disclosure deficiencies
  • Deposit handling and progress payment disputes
  • Unlicensed activity and licence-lending allegations
  • Qualifying individual and responsible management issues
  • Advertising and licence number display requirements
  • Recovery fund and guaranty fund claims
  • Insurance, bonding, and workers' compensation requirements

Contractor contract requirements are highly jurisdiction-specific, and several required disclosures exist precisely because their omission is itself a disciplinary violation.

Representation at Every Stage

How We Represent Contractors and Skilled Trades

  1. Stage 1

    Initial Complaint Response

The first written word a licensing authority receives from you often frames everything that follows. Stage 1 is the evaluation of the complaint or investigative notice and the preparation of a considered response.

  2. Stage 2

    Investigative Interview

Many authorities ask the licensee to speak with an investigator or appear before board staff. Stage 2 is preparation for that conversation and representation within the agreed scope of the engagement.

  3. Stage 3

    Informal Hearing or Conference

Several jurisdictions resolve matters at an informal stage — an informal fact-finding conference, an informal hearing, or a conference before board members or an agency subordinate. Stage 3 is preparation for and representation at that proceeding.

  4. Stage 4

    Formal Administrative Hearing

When a matter is not resolved earlier, it may proceed to a formal administrative hearing — before the board itself or before an administrative law judge, depending on the jurisdiction. Stage 4 is preparation for and representation at that hearing.

  5. Stage 5

    Post-Hearing Representation

A decision or order is not always the end of the matter. Stage 5 addresses what follows — what the order requires, what review may be available, and what is needed to return to practice.

Licensing authorities use different procedures and different terminology, and the sequence above is a general framework rather than a fixed path. Not every matter proceeds through all five stages — many conclude earlier, and some begin at a later stage. The stages that apply to your matter depend on the authority involved, the profession, the jurisdiction, and the posture of the case when we are engaged.

Frequently Asked Questions

Contractors and Skilled Trades — FAQs

No, though the facts overlap. A recovery or guaranty fund claim and a disciplinary proceeding are separate tracks with separate consequences, and how one is handled can affect the other. They are best considered together.

Frequently both. Where a qualifying individual or responsible managing employee stands behind the company's licence, that person's own credential can be at issue alongside the business licence.

Home improvement contractors in New Jersey hold a registration with the Division of Consumer Affairs. Electrical contractors, master plumbers, and HVACR contractors hold licences from their own examining boards. The distinction affects what conduct is regulated and how.
